The Texas law requires that all drivers be financially responsible when they are on the road. This financial responsibility comes in the form of automobile liability insurance. This insurance is used to cover the expenses incurred during the treatment, repair or replacement of any type of damage that has been brought by the accident in which the insured vehicle is involved. The coverage of the automobile insurance policy will depend on what the insurance company and the owner of the vehicle have agreed upon. Therefore, whatever is not covered by the auto insurance policy will have to be personally taken care of by either the owner of the vehicle or the driver.

In Texas, each vehicle is required to have an insurance that could pay $25,000 for the medical expenses of one injured person, $50,000 for the medical expenses for two or more injured persons, and $25,000 for the expenses in having the other party’s vehicle repaired. This minimum liability coverage is referred to as the “25/50/25 coverage.”

The medical and vehicle repair expenses may turn out to be costly than expected. Therefore, more people are getting auto liability insurance that is beyond the state’s minimum requirement to protect their own assets (cash or any type of asset that may be used to pay for the damages). You may ask your automotive insurance agent about the other coverage options, so that you could choose which option is best for your needs.

A couple of days, I got arrested for drunk driving and now I have to file an SR 22 form. What is it? Thing is, I’m going to be getting a new car. Will I have trouble getting it financed because of my SR 22 insurance requirement?

You shouldn’t.

The SR 22 auto insurance form doesn’t do much at all to hurt you except that it makes your car insurance rates go up, except for in special circumstances when your car insurance company allows you forgiveness for your very first drunk driving offense. It is, essentially, a form that the company must file so that the state has proof that you are covered by an auto insurance policy. In most states, you are required to have an auto insurance policy anyway, but the SR 22 helps these states keep track of you in this special case so that if you cancel your auto insurance, the department of public safety is notified so that your license may be suspended.

A new car can easily be financed while you are using SR 22 auto insurance, because the only thing that the financer looks at is whether or not you have the right kind of coverage. All they want to know is that, if you get into a car accident and have to make a car insurance claim, they will still get their paycheck for the amount of the loan. I do think I should call into question how wise it would be to finance a new car while you have SR 22 auto insurance, just considering what the rates would be. Already, SR 22 auto insurance rates are much higher than usual, as are those for new car insurance. Putting the two together might be a hard hit on your budget.

I was arrested for DUI and now they tell me that I have to file a Texas SR22 form. Thing is, I don’t own a car. Do I still have to get the SR22?

You definitely do.

Texas SR22 auto insurance is like all other types of insurance in that anytime someone who is required to have it is driving, they need to be insured it. When you don’t have to have SR22 car insurance, normally you can get by driving without your own insurance policy if you don’t own a car if you stick to driving the cars of friends who already have their own insurance policy for the vehicle. This works because a car insurance policy already covers most people who would drive that vehicle, be they friends of the owner or family members.

The difference between a regular insurance policy and an SR22 insurance policy in this case is that, unlike regular auto insurance, which is connected to the vehicle, the SR22 insurance is connected to you. You, as the person who was arrested for driving under the influence, have to have an SR22 car insurance policy, even if by some magical coincidence the car you are driving is owned by someone who also has a Texas SR22 auto insurance policy.

In order to get SR22 auto insurance while you do not have a car, you have to get an SR22 form filed for a non owner’s liability insurance policy. The non owner’s insurance policy is unfortunately lacking in optional coverage, which is disheartening for the driver that has to use one, but it is necessary if you do not have a vehicle registered under your own name. This SR22 non owner’s insurance policy covers only the damage you cause, the liability required by state. This includes things such as property damage and injury caused to the other driver and their property. Unfortunately, you can not add additional coverages such as collision and comprehensive, so the car that you’re driving isn’t protected unless the owner has it insured.
