Auto Insurance With An SR22 in Texas

Reader’s Question:

What is the purpose of having auto insurance with an SR22 here in Texas? I don’t think I have to get SR22 but I’m just curious how come many people have to get it.

Raul

Abilene, TX

Insurance with an SR22 is needed by a lot of motorists considered as high risk to insurance companies. SR22 is a form filed by the insurance company to the Texas Department of Public Safety (DPS) that proves that the person has the proper auto insurance coverage. Insurance with an SR22 is usually required of drivers who have been convicted of Driving While Intoxicated (DWI). SR22 filing serves as an assurance to the DPS that the motorist carries insurance required by the state. In case the insurance with SR22 ends or laps coverage, the insurer has to notify the DPS right away. As soon as this happens, DPS will suspend the driving privileges of the motorist as well as his/her driver’s license.

In Texas, insurance with SR22 is required for two to three years after the driver’s license has been reinstated. This information still has to be checked with the DPS to be sure about the particular SR22 insurance requirements. This is usually sent through mail in an official letter once the driver’s license has been reinstated.

To obtain insurance with an SR22, the driver has to shop with an expert insurance broker who could explain the policies available for insurance with an SR22. It is still necessary that anyone who needs insurance with an SR22 has to compare all the options available and pick the best one.

What Is The SR22 Filing Period

Reader question:

How long do I have to have SR22 filing for?

Leah

Thank you for asking, Leah.

The answer to your question depends on which state you are coming from. While most states have very similar laws concerning the SR22 filing period, some differ from others. For example, in Texas the period of SR22 filing is only two years, whereas in most other states that period is longer, around three to five years for a drunk driving or speeding offense.

The amount of time that you have to do SR22 filing also depends a lot on how many times you have committed the offense. If you commit it a second time, then you are going to get much harsher punishments than you would have if you had only done it once. Normally, committing the offense for a second time extends the period of SR22 filing by a couple of years, and then for a third time it doubles that new one. Every time it happens you have to do SR22 filing for longer, until you are no longer able to have a license at all.

One thing that I should mention is that the period during which your license is suspended counts towards the amount of time that you have to have SR22 car insurance coverage. So if your license is suspended for three months, once you get it reinstated, you will only have to pay for SR22 filing for your car insurance coverage for a year and nine months in th state of Texas.

How Do I File an SR22 in Dallas?

Reader question:

I have to do SR22 filing in Dallas and the car insurance company that I’ve been with for years doesn’t do SR22 filing policies. Can I keep my policy with them and then get an SR22 car insurance policy with another company?

Brook

Great question, Brook.

Unfortunately, that is not an option. You see, SR22 filing doesn’t mean that you’re getting this whole new type of insurance. There is actually no new change to your coverage, the only change is the larger penalty you will be hit with if you allow that coverage to lap. While it is possible to keep your auto insurance with one company while doing an SR22 filing with another, it does not make a lot of sense. You would basically be paying for two car insurance policies. If you want to get cheap SR22 filing, then that is the wrong road to go down.

It can be frustrating to lose your history with a certain car insurance company since you have been a policy holder with them so long. They might be a company that you really like and you might get certain benefits for being a long time customer. However, if you shop around thoroughly enough you can find another company that is just as good. The only way that you should consider holding two policies at once is if you have plenty of money to dispose of.

Is It Cheaper to File SR22 as Married Person?

Reader question:

Is it cheaper to do SR22 filing when you’re married?

Ramone

Thanks for asking.

That all depends on who you are married to. It is usually the case that married couples pay less for car insurance than do non married couples, and this is also true when SR22 filing is involved. The main reason for this is that being married is seen as being responsible and married people file fewer claims than unmarried people, so car insurance companies charge them less. It also tends to be because when you get married, you join together your car insurance policy, and so you go from a one name one car policy to a multiple policy, which tend to cost less. In a marriage, the person that usually benefits the most from lower car insurance rates is the male, because guys tend to pay more for their car insurance, an amount which is tempered when married.

However, this does not always apply. It is much the same when you have great credit and you marry someone with terrible credit, and then you try to apply for a house together. You might have less luck than if you had applied alone. It goes the same way if you marry and join car insurance policies with someone who has a very bad driving record. If your spouse has a good driving record, then you might benefit from that some by having to pay less for your SR22 filing. However, if your spouse has a bad driving record, then it will just cost more.

Texas SR22 Auto Insurance Removal From Your Record?

Reader question:

How do I remove my Texas SR22 auto insurance filing from my record?

Emily

Glad you asked.

Texas SR22 auto insurance is something that you have to file with whatever car insurance company that you are with for the three or five, or however many years you ended up with, that you are required by the state to show proof of auto insurance for your car. If you fail to file it during that period of time, or your car insurance policy gets cancelled or it doesn’t get renewed, then until you can get your SR22 filing for car insurance back, your license will be suspended. This is a hassle, especially since in most cases you are required to pay a reinstatement fee. All in all, the removal of your SR22 car insurance should be taken seriously and should not be something that you do until the required time period has ended, or you decide that you will not be driving until it does.

Now, when you remove the SR22 form from your insurance policy, your car insurance company has to file another form, which is called the SR26. The SR26 gets filed whether your period is over or not, but if you want to continue having insurance with a company and also want to have an SR26 filed, then you have to show them some kind of proof that you are no longer required to have it. If the SR26 form is filed and you do still have to have Texas SR22 auto insurance, then your license gets suspended.

How Long Are You Required To Have an SR22 Filing

September 14, 2007 by · Leave a Comment

Reader question:

For how long are you required to have SR 22 filing done?

Adam

Excellent question, Adam.

The truth is that the necessity and length of the SR 22 filing process depends on a number of factors. The SR 22 filing requirement is one that comes after you have been convicted for something such as driving while intoxicated, driving under the influence of mind altering drugs (which also comes with even heavier penalties, along with the drunk driving), and driving without proof of financial responsibility; the requirement becomes even more strict when any of these actions result in a car accident. If you are simply caught from being pulled over by a police officer, then the requirements are less strict.

The first factor that affects how long you have to do SR 22 filing is your possession of a license. Normally, if you are required to file an SR 22 form, then you must first have had your driver’s license suspended. Sometimes the suspension lasts for a certain amount of time before you are able to reinstate it with SR 22 auto insurance coverage proof. Other times, it is only suspended until you pay a fee (which varies from state to state) and provide the DMV with your SR 22 form. The key to all of this is that the period during which you are required to do SR 22 filing applies whether or not you have a driver’s license. Theoretically, you could simply choose to take the bus for three years after your license was first suspended before reinstating it. If you did this, then you would never have to pay for expensive SR 22 auto insurance coverage.

The other factor that affects your SR 22 filing requirement is the number of times you have committed the offense in question. For example, if this is your second time getting thrown in jail for driving while intoxicated, then the amount of time you have to file an SR 22 form lengthens considerably. The normal amount for most first time cases is three years. For drunk driving, though, it is five years in most states. The second time you are caught drunk driving, that number of years doubles to ten years. The third time, it doubles again, to twenty years.

Cheers.
